Nur der freie römische Bürger sui iuris hat volle Rechtsfähigkeit. Die capitis deminutio stuft ab: maxima vernichtet die Freiheit (und damit alles), media die Bürgerschaft, minima verändert nur die Familienzugehörigkeit (z. B. adoptio, emancipatio).
