Haftungsverteilung nach dem Utilitätsprinzip: Der Entleiher hat den Nutzen → er haftet streng (custodia, also auch für Diebstahl durch Dritte); der Verwahrer hat keinen Nutzen → er haftet nur für dolus und culpa lata. Verschuldensunabhängige Grenze beidseits: vis maior. Aufwendungsersatz über actio contraria. ## Moderne Parallele BGB: Leihe §§ 598 ff. — § 599 BGB privilegiert den VERLEIHER (nur Vorsatz/grobe Fahrlässigkeit), während der Entleiher voll nach §§ 276, 280 BGB haftet; das Utilitätsprinzip wirkt also fort, aber als Privilegierung des Unentgeltlich-Leistenden. Verwahrung §§ 688 ff. mit § 690 BGB (eigenübliche Sorgfalt bei Unentgeltlichkeit) als depositum-Erbin. ## Typische Fehler
