Einsatzlage Ein Investor beruft sich gegenüber einem Staat auf ein bilaterales Investitionsschutzabkommen, die Energiecharta, das ICSID-Übereinkommen oder eine gesonderte Schiedsvereinbarung. Die bloße Bezeichnung als ICSID-Verfahren beantwortet weder die unionsrechtliche Wirksamkeit der Zustimmung noch Zuständigkeit, Aufhebung oder Vollstreckbarkeit. ## 2. Normenanker - Artikel 19 EUV sowie Artikel 267 und 344 AEUV: Autonomie, Vorabentscheidung und unionsinterne Streitbeilegung. - Das konkrete BIT, Artikel 26 des Energiecharta-Vertrags oder das maßgebliche Investitionsschutzkapitel: persönliche, sachliche und zeitliche Reichweite sowie Zustimmung zur Schiedsgerichtsbarkeit. - ICSID-Übereinkommen, besonders Artikel 25, 41, 52 und 54: Zuständigkeit, Kompetenz-Kompetenz, Aufhebung und Anerkennung. - Paragrafen 1025 bis 1066 ZPO, besonders Paragrafen 1040, 1059 und 1061 ZPO: Verfahren mit deutschem Schiedsort, Aufhebung und Vollstreckbarerklärung nicht-ICSID-basierter Schiedssprüche. - New Yorker Übereinkommen, besonders Artikel V, für Anerkennung und Vollstreckung außerhalb des ICSID-Regimes. ## 3.
