Die stipulatio ist das Universalwerkzeug: jede beliebige Leistung wird durch Frage-Antwort-Form klagbar (stricti iuris). Formlose pacta sind nur einredeweise geschützt (pacta de non petendo) — nuda pactio obligationem non parit.
