Hypothek ist akzessorisch, formfrei, an allem Verkehrsfähigen möglich — auch Generalhypotheken am Gesamtvermögen waren üblich (Publizitätsproblem!). Rangfolge: prior tempore; Privilegien (Fiskus, Mitgift) durchbrechen die Zeitreihenfolge. ## Moderne Parallele BGB spaltet auf: Faustpfand §§ 1204 ff. (strenges Publizitätsprinzip — Reaktion auf die römische Heimlichkeit!), Hypothek/Grundschuld §§ 1113 ff./1191 ff. nur an Grundstücken mit Grundbuchpublizität.
