eu-ai-act-classification-oliver-schmidt-prietz
Determines whether a technology qualifies as an AI system under Art. 3(1) of the EU AI Act and classifies its risk tier (prohibited, high-risk, GPAI with systemic risk, limited risk, minimal risk). This skill should be used when the user asks to "classify an AI system under the AI Act", "determine the AI Act risk tier", "check if something is an AI system", "assess prohibited practices", "check high-risk classification", "determine Art. 6 exception applicability", or mentions "KI-Verordnung", "Risikoklassifizierung", Art. 5, Annex III, or GPAI systemic risk.

What it does
Determines whether a technology qualifies as an AI system under Art. 3(1) AI Act and classifies its risk tier (prohibited, high-risk, GPAI with systemic risk, limited risk, minimal risk).
How it works
The skill guides the user through a phased assessment:
- Phase 1: Scope Gate — collects a description of the system and evaluates scope exclusions; if exclusions apply, it directs exclusion analysis and may stop; if open-source license applies, it runs an open-source checklist; otherwise proceeds.
- Phase 2: AI System Definition Test (Art. 3(1)) — walks through seven criteria one by one: machine-based operation, degree of autonomy (ISO 22989 scale), adaptability after deployment (learning from data/feedback), explicit or implicit goals, inference capability, output generation, and environmental influence. After evaluating all criteria, it provides a structured AI System Definition Analysis table and a determination whether the system IS or IS NOT an AI system under Art. 3(1).
- Phase 3: Risk Classification — conducts prohibited-practices screening (Art. 5) with a tabular presentation of eight prohibited practices, then proceeds to a High-Risk Check via Annex I product safety categories, Annex III application-based categories, and an Art. 6 exception check if Annex III is triggered. If applicable, performs a deep high-risk assessment per Art. 6 guidance, documenting conclusions with reasoning and references, and outputs a final risk-tier classification.
The skill emphasizes that final legal conclusions should involve qualified counsel and cites specified guidance and annexes during the classification process. It requires web searches during certain phases (e.g., guidelines, Annex III changes, GPAI thresholds).
When to use it
Use when the user asks to classify an AI system under the AI Act, determine the AI Act risk tier, check if something is an AI system, assess prohibited practices, check high-risk classification, determine Art. 6 exception applicability, or mentions related terms like KI-Verordnung, Risikoklassifizierung, Art. 5, Annex III, or GPAI systemic risk.
What it can touch
The skill references web search prompts and internal reference materials (e.g., references/prohibited-practices.md, references/high-risk-annexes.md, references/sector-guidance.md, references/art6-exception.md, references/ai-system-definition.md, and related Annex III categorization). It instructs the agent to rely on those sources for depth analysis during the risk classification workflow.
Caveats
The skill includes a disclaimer that the classification is not legal advice and that final decisions should involve qualified legal counsel. It specifies that dates and guidance reflect the AI Omnibus 2026 postponement and related Annex dates.

What does the eu-ai-act-classification-oliver-schmidt-prietz skill do?
Determines whether a technology qualifies as an AI system under Art. 3(1) of the EU AI Act and classifies its risk tier (prohibited, high-risk, GPAI with systemic risk, limited risk, minimal risk). How do I install it?
Run `npx skills add lawve-ai/awesome-legal-skills --skill eu-ai-act-system-classifier-oliver-schmidt-prietz --agent claude-code` — it drops the skill into your project so the agent can pick it up. Swap the --agent value for codex, cursor or copilot if you use one of those.
Where does this skill come from?
From lawve-ai/awesome-legal-skills, a repository with 618 stars. We read it straight from the repository tree rather than a submitted listing, so what you see here is what is actually published.
Is a popular skill a good skill?
Not necessarily. Stars measure attention, not adoption — a repository can trend for a week and be abandoned. That is why we show the weekly change from our own snapshots next to the total, instead of a single flattering number.
