Purpose (EN): Audit and inspection rights under Article 28 (3) (h) GDPR. ## Wann dieses Modul hilft - Audit-Klauseln im AVV werden verhandelt. - Verantwortlicher will ein Vor-Ort-Audit durchfuehren. - Auftragsverarbeiter verweist auf Zertifikate (ISO 27001, SOC 2, BSI C5) und will Vor-Ort-Audit ausschliessen. - Aufsichtsbehoerde fordert Audit-Nachweise. ## Rechtlicher Rahmen - Art. 28 Abs. 3 lit. h DSGVO: Auftragsverarbeiter stellt dem Verantwortlichen alle erforderlichen Informationen zum Nachweis der Einhaltung der in Art. 28 niedergelegten Pflichten zur Verfuegung und ermoeglicht Überprüfungen, einschliesslich Inspektionen, die vom Verantwortlichen oder einem anderen vom Verantwortlichen beauftragten Prüfer durchgefuehrt werden, und traegt zu diesen bei. - Art. 32 DSGVO: TOM-Pflicht, die Audit-Grundlage ist. - Art. 42, Art. 43 DSGVO: Zertifizierungen und Prüfstellen. - Art. 40 DSGVO: Verhaltensregeln (Codes of Conduct). - § 17
