Gegen den quiritischen Eigentümer dringt sie nur durch, wenn dieser die exceptio rei venditae et traditae gegen sich gelten lassen muss; gegen gleichrangige Erwerber gilt: prior tempore. ## Moderne Parallele Funktional ersetzt durch §§ 932 ff.
